Landfill Levy


2010


As of 1 February 2010, the Minister for the Environment, Heritage and Local Government increased the landfill levy, using the power available to him under the Waste Management Acts.

The Waste Management (Landfill Levy) Order 2010 (SI 13 of 2010) amends Section 73(3) of the Waste Management Acts 1996 to 2008 to allow for the landfill levy to be increased by €5 to €30 per tonne for each tonne of waste disposed of at authorised and unauthorised landfill facilities.

The Minister has also made the Waste Management (Landfill Levy)(Amendment) Regulations 2010 (SI No. 31 of 2010) which amends the 2008 Regulations to implement the increased levy of €30 per tonne for waste disposed of at authorised and unauthorised landfill facilities.

As of 1 February 2010, the landfill levy rate is €30 per tonne for each tonne of waste disposed of at authorised landfill facilities and at unauthorised landfill facilities.

These increases are a transitional measure as the Minister proposes to bring forward primary legislation to amend the Waste Management Acts. The proposed legislation will allow the Minister to apply significantly higher levy rates with a view to deploying this economic instrument to drive the diversion of waste from landfill. This will also have regard to the targets that have to be met under Council Directive 1999/31/EC of 26 April 1999 on the landfill of waste.



2009


As of 31 December 2009, the Minister for the Environment, Heritage and Local Government increased the landfill levy, using the power available to him under the Waste Management Acts.

The Waste Management (Landfill Levy) Order 2009 (S.I. 496 of 2009) amends Section 73(3) of the Waste Management Acts 1996 to 2008 to allow for the landfill levy to be increased by €5 to €25 per tonne for each tonne of waste disposed of at authorised and unauthorised landfill facilities.

The Minister has also made the Waste Management (Landfill Levy) Amendment Regulations 2009 (SI No. 550 of 2009) which amends the 2008 Regulations to implement the increased levy of €25 per tonne for waste disposed of at authorised and unauthorised landfill facilities.
As of 31 December 2009, the landfill levy rate is €25 per tonne for each tonne of waste disposed of at authorised landfill facilities and at unauthorised landfill facilities.


2008



As of 1 July 2008, the Minister for the Environment, Heritage and Local Government increased the landfill levy, using the power available to him under the Waste Management Acts.

The Waste Management (Landfill Levy) Order 2008 amended section 73(3) of the Waste Management Acts 1996 to 2008 to allow for the landfill levy to be increased from €15 per tonne to €20 per tonne for each tonne of waste disposed of at an authorised landfill facility.

As of 1 July 2008, the landfill levy rate is €20 per tonne for each tonne of waste disposed of at authorised landfill facilities. The landfill levy rate remains at €20 per tonne for each tonne of waste disposed of at unauthorised landfill facilities.


2006


As a penalty for those who illegally deposit waste, the Waste Management (Landfill Levy)(Amendment) Regulations 2006 introduced a levy of €20 per tonne for each tonne of waste disposed of at unauthorised facilities on and from 28 July 2006. This means that persons responsible for the illegal deposition must pay the levy and remove the waste, as required by Section 60 Policy Direction, and remediate the land, apart from any other penalties that may be imposed through the courts.


2002


A levy of €15 per tonne on the landfill of waste was introduced on 1 June 2002 under the Waste Management (Landfill Levy) Regulations 2002. The levy is designed to encourage the diversion of waste away from landfill and generate revenues that can be applied in support of waste minimisation and recycling initiatives. All levies are remitted to the Environment Fund.
