Landfill Levy


2011


From 1 September 2011, the Minister for the Environment, Community and Local Government increased the landfill levy, using the power available to him under the Waste Management Acts.The Waste Management (Landfill Levy) Regulations 2011 (SI No. 434 of 2011) increased the landfill levy by 20 euro to 50 euro per tonne for each tonne of waste disposed of at authorised and unauthorised landfill facilities.

Therefore, as of 1 September 2011, the landfill levy rate is 50 euro per tonne for each tonne of waste disposed of at authorised and unauthorised landfill facilities.The Regulations also allow for certain other revisions, including in relation to exemptions from the levy.

Section 73(5A) of the Waste Management Act 1996, as inserted by Section 13 of the Environment (Miscellaneous Provisions) Act 2011 (No. 20 of 2011) (pdf, 140kb), also provides for changes to the way that interest is calculated on late payment of the levy. The rate applicable on and from 1 September 2011 is 0.0322 per cent simple interest for each day or part of a day during which the amount remains unpaid.
 
The amendments to the Waste Management Act 1996 in relation to the landfill levy, brought about by the commencement of certain provisions of the Environment (Miscellaneous Provisions) Act 2011 (No. 20 of 2011), aim to give greater flexibility in the setting of the landfill levy. This aim is driven by the challenging targets set for Ireland in the EU Landfill Directive (1999/31/EC) with regard to the diversion of biodegradable municipal waste from landfill. Significant increases in the maximum landfill levy and in the annual maximum amount by which it can be increased are warranted in order to maintain the dissuasive impact of the levy and to drive recycling and diversion from landfill.

2010


The Minister of the Environment, Heritage and Local Government increased the landfill levy, using the power available to him under the Waste Management Acts, to 30 euro per tonne for each tonne of waste disposed of at authorised and unauthorised landfill facilities with effect from 1 February 2010.


2009


As of 31 December 2009, the Minister for the Environment, Heritage and Local Government increased the landfill levy, using the power available to him under the Waste Management Acts, to 25 euro per tonne for each tonne of waste disposed of at authorised and unauthorised landfill facilities.


2008


The Minister for the Environment, Heritage and Local Government, using the power available to him under the Waste Management Acts, increased the landfill levy rate for waste disposed of at an authorised landfill facility from 15 euro per tonne to 20 euro per tonne with effect from 1 July 2008.

The landfill levy rate remained at 20 euro per tonne for each tonne of waste disposed of at unauthorised landfill facilities


2006



As a penalty for those who illegally deposit waste, the Waste Management (Landfill Levy)(Amendment) Regulations 2006 introduced a levy of 20 euro per tonne for each tonne of waste disposed of at unauthorised facilities on and from 28 July 2006. This means that persons responsible for the illegal deposition must pay the levy and remove the waste, as required by Section 60 Policy Direction, and remediate the land, apart from any other penalties that may be imposed through the courts.


2002


A levy of 15 euro per tonne on the landfill of waste was introduced on 1 June 2002 under the Waste Management (Landfill Levy) Regulations 2002. The levy is designed to encourage the diversion of waste away from landfill and generate revenues that can be applied in support of waste minimisation and recycling initiatives. All levies are remitted to the Environment Fund.
